Program Description:

During this presentation on advanced trust planning, Ilene will clarify and define clients which are most suited to advanced trust planning.

She will discuss the following two most common advanced trusts, 
IRA Trusts and Supplemental Needs Trust, (formerly special needs trusts), as well general information regarding 
Charitable Trusts: (CRTs and CLTs) and Intentionally Defective Grantor Trusts (IDGT). 

As a sample of the information specific to IRA trusts, Ilene will walk you through considering the following:
  1. Control, Income and Estate tax benefits of IRA Planning with standalone IRA Trusts.
  2. Is asset protection still available to IRA Beneficiaries? 
    • Prior to Clark v. Rameker, yes.   But now…
    • What are the new rules after Clark v. Rameker?
  3. Who is protected?   Who is not protected from creditors and predators?

You will be surprised by the answers.


Ilene will also define the interactions between foundation trusts, also known as Family Revocable Living Trusts, with any one or more of the Advanced Trusts.

Finally, we will look into the CONTROL process and learn to determine when our clients have achieved CONTROL over their planning.
